Man charged with stalking, violating protection order

Kirk A. Smith, has been charged with a felony after being accused of his fourth violation of an order of protection.

Court charging documents say police dispatch received a call April 23 from someone who said Smith, whom she had a protection order against, had been driving in the area.

While an officer was on the way to the scene, the documents say the caller told the dispatcher that Smith was near her vehicle before he ran and took off in his pickup truck.

Smith was pulled over and the officer noticed he was “breathing heavier than a normal person would be.”

The officer told Smith of the allegation that he was seen near the caller, and the caller took video footage showing he was there.

The documents say Smith told the officer that he was in the area to see his son, who was at a friend’s house, but added that he never left his vehicle.

The footage taken by the caller, although “not of good quality,” identified Smith, in part because he appeared to be wearing the same clothes as when he was pulled over. Footage shows him running from the scene, as described by the caller, the documents say.

Charging documents say the previous instances in which Smith is accused of being near the caller include calling her at work, showing up a their previous shared residence, showing up at or near her boyfriend’s house and being near her vehicle when it was parked.

The caller told officers that Smith’s following and “harassing” have caused her a lot of emotional stress, the documents say.

Smith is charged with a felony count of stalking and a misdemeanor count of violation of order protection. His arraignment is scheduled for Monday at 2 p.m.
