Havre pot dealers get probation  

Two Havre men arrested, after 422 grams of marijuana and 5.5 grams of hashish was found in the residence where they were staying, each received three years probation Wednesday in state District Court in Havre.

Cameron Morelli, born in 1996, received a three-year deferred imposition of sentence for a felony charge of criminal possession of dangerous drugs and was ordered to pay a $3,378.88 drug storage fine. Gary Phipps, born in 1970, received a three-year deferred imposition of sentence for criminal possession with intent to distribute, a felony, and ordered to pay a $3,378.88 drug storage fine.

Each sentence was part of plea deal that dropped misdemeanor charges. If Morelli and Phipps abide by the conditions of their sentences, they can have the convictions struck off their records.

Safe Trails Tri-Agency Task Force agents executed a search warrant on a West Havre residence March 30, court documents say, where they found Phipps being escorted out and Morelli sleeping on the couch. A hat with Morelli’s name was found nearby, indicating he had been staying at the house.

Agents found drug paraphernalia like scales, marijuana smoking devices, sandwich bags, containers to store drugs in, as well as marijuana and hashish, in the home. Three bags of marijuana were found in Phipps’ room.

Agents seized cellphones, surveillance cameras, the wires and DVR attached to the cameras, and a safe filled with bags of marijuana and $2,000 in cash. Agents were able to connect one of the $20 bills to a controlled sale made to a suspected pot dealer by its serial number, documents say. A ledger with information on who the marijuana was being bought from and who owed money was also found in the safe.

Havre woman gets probation for selling pot

A Havre woman received three years probation Wednesday in District Court for selling marijuana to an informant.

Kyndyll McGarvey, born in 1994, received a three-year deferred imposition of sentence for two felony counts of criminal distribution of dangerous drugs. The sentence was part of a plea deal.

An informant told a Safe Trail Tri-Agency Task Force agent Oct. 15, 2015, that McGarvey offered to sell them a “$50 bag of weed,” a court document says.

The agent did a background search on McGarvey and found two previous incidents in which she was around marijuana.

The agent wired and prepared the informant for a controlled sale with McGarvey.

The informat met with McGarvey at a Boulevard Avenue address, where a plastic bag of marijuana was bought.

During the debrief, the informant told agents that McGarvey took the money and went to her mother’s house in the Smithville area to get the marijuana.

The informant had set up another controlled sale of an eighth-ounce of marijuana from McGarvey four days later, Oct. 19, through Facebook. Wired again, the informant went to the same address they went four days ago to meet with McGarvey, who again left the residence and came back with three baggies of marijuana, one of which was sold to the informant, documents say.
