From the Courts - State District Court: Woman resentenced to custody in drug distribution charge

Nina M. Demontiney had a suspended sentence revoked and was resentenced to 30 months in custody after she was found to have violated conditions of her release.

Demontiney was under supervision on a five-year sentence imposed for a 2011 charge of criminal possession of drugs with the intent to distribute and criminal possession of drugs, when she was charged in 2016 with a new charge of criminal possession of drugs with the intent to distribute and with   possessing property subject to forfeiture, $2,123 in cash and a GMC Sierra pickup truck.

She was sentenced on the new charges in 2016 to three years to the state Department of Corrections, all suspended, on both charges and ordered to forfeit the property to the state.

The suspended sentences were to run at the same time, but after the sentence on the 2011 charges was complete.

May 15, the court found the state had proven one or more of the allegations Demontiney had violated conditions, which included using drugs and alcohol, being arrested, failing to report, being in a bar and not attending counseling sessions.

Monday, state District Judge Kaydee Snipes Ruiz revoked the suspended sentence and resentenced Demontiney to 30 months with the DOC, recommending she be screened and placed in treatment, and credited her with 122 days served but with no credit for street time.
