GREAT FALLS (AP) - A man charged with killing his 3-month-old daughter after allegedly passing out on top of her faces a lesser charge because the cause of death could not be determined, officials said.
Cascade County Attorney Brant Light has filed a lesser charge of felony criminal endangerment against Anthony Gonzales, 31. He was charged with negligent homicide at the end of May for allegedly rolling on top of Angelika Lame Bear while drunk.
''We can't differentiate between deliberate suffocation and SIDS,'' Light said. ''It makes things difficult for us.''
By charging Gonzales with criminal endangerment, prosecutors must prove only that he created a risk of death or serious bodily injury to the child, Light said.
