A New Jersey man who was in the area working with a carnival is being held in the county jail on $75,000 bond while awaiting a hearing on a charge of rape accused of having sex with an underage girl in Havre.
The Hill County attorney’s office charged Joshua Nessederine, born in 1989, with a felony count of sexual intercourse without consent after he was accused of having sex with an unwilling 15-year-old.
According to the charging document, a woman reported on July 24 that an assault had occurred. The woman told a Havre police officer that Nessederine, who she identified only as Josh, an employee of a carnival, had had sex with the girl July 18.
The document said the girl told investigating officers that Nessederine had visited her at her place of employment in Havre right before the Blaine County Fair in Chinook started, and they exchanged telephone numbers.
On July 18, she said, she had gone to see a movie in Havre with Nessederine with some of her friends. After the movie, they went to a local business at which Nessederine purchased alcohol.
They then went to the residence in Havre of one of the girl’s friends to drink and play cards, the charging document says.
After the girl found she could not go to another house to stay the night, she decided to stay at the house where they had played cards and drank, the document said.
Nessederine went into the bedroom where she would be sleeping, and although the girl told him she didn’t want to have sex, she said, he “insisted that it would be all right. ”
He had sex with her a total of four times during the night, the girl said.
Officers collected evidence at the residence where the girl said the sex had occurred, and the other people who were there told the officers that the girl had told them the next morning that Nessederine had had sex with her several times that night.
An arraignment hearing for Nessederine had not been scheduled as of this morning.
First off, don't waste the time punishing only one side of this. BOTH sides were WRONG. Spare me the tired story of how the "poor little girl" in this matter was so horribly vicitimized. Go on facebook sometime and tell me how innocent your kids are. Let us not forget the FACTS involved here.
The "victim" was hanging out with this guy days BEFORE the event in question took place - where were her PARENTS? The "victim" exchanged phone numbers with him -where were her PARENTS? The "victim" was so intoxicated that she had neither the presence of mind to call her parents to ask for help, nor to perhaps scream to her friends during one of the FOUR TIMES they did the deed? Give me a break. This was buyer's remorse.
I was 15 once upon a time, and I KNEW, just like all of you did, PRECISELY what I was doing. I also KNEW when it was WRONG. Here's the bottom line. She was HAMMERED, so it's safe to assume that she didn't demand her new found love use a condom. She woke up hung over and PARANOID that she might have an STD or become PREGNANT. She has to cover her backside somehow, so she yells "RAPE". This scenario has played out more times than anyone can possibly imagine. Time to face facts.
Let's see the "victim's" text message/call log and see what they sent back and forth. Pics, perhaps? Plans for a rendezvous? Sorry for the bleeding heart "advocate" that posted below, but I've worked in REHAB for these kinds of kids. They are not all wonderful little cherubs who are sinless. In fact, more times than not, the child is vastly more intelligent than the parent...who most times are SO oblivious to the reality of the child's life - that they simply disconnect altogether.
I'd bet nickels to pesos that were we to REALLY get down to brass tacks in this...that the locatable FACTS would indicate that the "victim" here...is the guy who believed a girl who told him she was 18. You'd have to be an utter MORON to lure a 15yr old into a drunken stupor induced sex coma (4 times) and NOT expect to get tagged for it.
Dig your heads out of the sand and get with it people. Kids are not as stupid as you treat them, they are smarter than you. Kids are NOT as innocent as you want to think, they could tell you about things that would make you blush. Ask the local Junior High about activities there as of late.
I think ALL PARTIES in this matter should be punished to the fullest extent of the law. INCLUDING the "victim". Polygraph her butt. The PARENTS most of ALL should burn for this. Had they been doing their job to begin with, this would NEVER HAVE HAPPENED.
