A Havre man is going to prison after admitting in 12th Judicial District Court that he violated conditions of his suspended sentences on at least five occasions.
Samuel Duane McBride, 27, Havre, appeared on Oct. 12, according to court documents, to answer allegations that he violated conditions of his release by breaking the law, drinking alcohol, and entering into a contract without permission.
District Court Judge John Warner revoked McBrides two concurrent, five-year suspended sentences and sentenced him to five years in Montana State Prison in Deer Lodge. Warner gave McBride credit for about 7 months he served in Hill County Jail between Sept. 29, 1998 and Feb. 24, 1999, and between July 25 and Oct. 12, 1999.
The original sentence stemmed from two burglaries in December 1994. A jury found McBride guilty Feb. 22, 1996 to burglarizing homes in the 1100 block of Sixth Street North and the 600 block of Second Street.
McBride was sentenced March 25, 1996 to two concurrent 10-year prison sentences with five years of each sentence suspended. Judge Warner recommended McBride for participation in the Boot Camp program at that time.
McBride was ordered, among other conditions at that time, to pay $2,100 restitution to his victims.
