A Havre man who admitted sexually abusing young children last year was given two concurrent 30-year prison sentences here Thursday.
Timothy Andrew Narayan Gamble, 22, Havre, pleaded guilty Nov. 27 of last year to raping a 10-year-old girl and exposing himself to another girl and a boy, both 8. The incidents, for which he was charged with sexual intercourse without consent and sexual abuse of a child, both felonies, occurred in Havre on or about June 27, 2000.
Twelfth Judicial District Court Judge John Warner said he made the sentences concurrent because Gamble committed the offenses in the course of the same criminal incident.
Warner suspended the last 10 years from each of the concurrent sentences and gave Gamble credit for 220 days he already spent in jail. With the concurrent sentences and 10-year suspensions, Gamble actually received a 20-year sentence, provided he complies with numerous pages of conditions laid down by Judge Warner.
While in prison and upon his release, Gamble must remain under the supervision of the Department of Corrections, comply with all city, county, state and federal laws, cooperate and be truthful with his parole and probation officers, undergo a drug and alcohol evaluation and follow the recommendations of his counselor, complete a DNA test, have no unsupervised contact with children, including in his employment, have no contact with his victims or their families, possess no pornography, alcohol or drugs, police scanner or radio, or firearms, submit to tests of his bodily fluids and searches of his person, vehicle and home, have no contact with criminals, pay the mandatory supervisory fee.
Judge Warner waived all other fees and surcharges because of Gamble's inability to pay.
In his written reasons for his sentencing decision, Judge Warner labeled Gamble a dangerous pedophile who "did great violence to the lives of the young children he victimized." He found that while this was Gamble's first felony offense, there were no "personal or family reasons which make it unadvisable for him to go to prison." Warner also found that there was no possibility of restitution to the victim.
A pre-sentence investigation, including a psychosexual evaluation and letters from the victims and their families, was taken into consideration prior to sentence.
Warner identified Gamble as a pedophile who preys on young children and labeled him a Class III sexual offender. As a Class III offender, Gamble must register as a sexual offender with law enforcement officials in communities where he resides.
