Drugs, burglary, theft and probation violations fill district court docket

Four men were sentenced on criminal charges in 12th

Judicial District Court here in mid February and one is

awaiting sentencing for admitting probation violations.

Pete Sutherland, 40, Rocky Boy, last week admitted six drug

offenses and failing to pay restitution in violation of his

conditions of release. Disposition of his case was set for 4

p.m. March 14.

Sutherland was sentenced to 25 years in prison with 15

years suspended for the May 16, 1986 stabbing death of Randy

Stuker in downtown Havre. He also was given two years to

serve consecutively for use of a weapon in the assault.

Sutherland was released on probation Dec. 27, 1993. He

admitted violating conditions of his release in December

1997 and was given additional chemical dependency conditions

to abide by in his suspended sentence.

Sutherland was released Jan. 29 on $5,000 bail.

Arthur Roy Lawrence, Jr., 26, Havre, pleaded guilty to

obstructing a peace officer and was given a 6-month

suspended sentence. He was ordered to pay all fees and

surcharges and given credit for time served. Lawrence was

caught harboring a man wanted by police on May 9, 2000.

Michael W. Kaftan, 40, Havre, pleaded guilty to three

counts of obtaining drugs fraudulently. He was sentenced to

five years in Montana State Prison on each count. The first

and second counts were to run concurrently and the third was

to be consecutive with the first two. All three were

suspended provided Kaftan abides by conditions set down in

his pre-sentence investigation. He was ordered to pay

supervisory fees.

Kaftan admitted altering and falsefying prescriptions

between September and November 1999.

Jason Richard DeLorme, 20, Havre, was given a 5-year

suspended prison sentence on the condition that he abide by

conditions set down in the pre-sentence investigation. He

also must pay the remaining $2,295 of restitution owed.

DeLorme was given credit for 38 days served and his fees and

surcharges were waived. His sentence is to be served

concurrently with his sentence from Chouteau County.

DeLorme pleaded guilty Dec. 22, 2000 of stealing items from

a Havre apartment on Oct. 23, 1999.

Troy McGarvey, 34, Kalispell, was sentenced Feb. 14 to two

years in Montana State Prison. The judge suspended the

sentence on conditions. There was no fine, but McGarvey was

ordered to pay restitution and all court fees and

surcharges.
