HasEagle rape trial set for June

The trial of a man arrested on warrants after failing to appear on charges of rape and probation violation has been set tentatively for June 24.

State District Judge Dan Boucher scheduled the trial for Donald J. HasEagle of Havre, born in 1988, as setting number nine, meaning eight other trials potentially scheduled also are listed to be held starting that day.

Local and federal arrest warrants were issued for HasEagle after he failed to appear for a June 24 court hearing on the rape charge.

HasEagle was charged with sexual intercourse without consent and with probation violation after a woman reported that on April 14 she had been at a Havre residence drinking. She eventually went into a bedroom with HasEagle, and they began to have sex, she said, to which she consented.

HasEagle told her he wanted to have sex in different ways, and she did not want to, the woman said.

Despite her telling him to stop, he began to have sex in ways to which the woman did not consent, and would not let her leave. She called out for help, but everyone else had left the residence, she said.

He also faces a charge of probation violation stemming from his pleading guilty in a plea agreement in 2012 to a reduced charge in a separate case. He was charged in 2011 with felony counts of assault with a weapon and criminal endangerment and a misdemeanor count of partner or family member assault, first offense.

Under the plea agreement, he pleaded guilty to a reduced charge in the first count, criminal endangerment instead of assault with a weapon, and to the misdemeanor assault charge.

The judge imposed a three-year deferred imposition of sentence. Under a deferred imposition of sentence, a defendant can request all felony charges be struck from their record if they abide by all conditions of their release.

HasEagle denied violating conditions in a hearing Jan. 28. An evidentiary hearing in which the prosecution will present its arguments and evidence is set for Feb. 21.

Havre police officers arrested HasEagle the morning of Dec. 30 in Havre on the 1900 Block of 1st Street Northeast, seven months after the original warrant for his arrest was issued.
