Habeger trial pending

A case against one man accused of selling drugs to a man who then was found “freaking out” has been resolved, with the trial of another defendant in the case still pending.

Wesley J. Hansen, born in 1987, pleaded guilty in a plea agreement to felony charges of possession of methamphetamine and possession of property subject to forfeiture, with a felony count of possession of methamphetamine with the intent to distribute and a misdemeanor count of possession of drug paraphernalia dismissed under the agreement.

State District Judge Dan Boucher imposed two three-year deferred imposition of sentences to run at the same time for the felonies, and ordered Hansen to pay $846.25 in fees, surcharges, fines and cost of assigned counsel and to forfeit $254.75 in cash seized during the investigation.

If Hansen abides by all of his conditions of release while under probation, he can petition to have the felonies stricken from his record.

Cory J. Habeger, born in 1987, faces trial Sept. 9 on felony counts of criminal possession of methamphetamine and criminal possession of the prescription painkiller hydrocodone and a misdemeanor charge of criminal possession of drug paraphernalia.

Habeger and Hansen were charged after a police officer responded in the early morning of Jan. 8 to a report of a man at a parking lot on the 700 Block of 1st Street who was “acting strangely,” a charging document says.

The officer said the man, Alex Eakins, said he had purchased drugs from Habeger and “done a line” and “started freaking out.” The officer said Eakins, who pleaded guilty to a misdemeanor charge of possession of marijuana Jan. 10 in Havre City Court, was hallucinating and the officer called the Havre Fire Department emergency medical technicians to check his condition.

When officers responded to the residence where Eakins said he purchased the drugs, they observed Habeger and Hansen through the window, the document says, and when they knocked on the door, the two began apparently trying to hide things before opening the door.

Habeger told the officer he had drugs on him, the document says, and pulled a vial containing a substance that field-tested positive for methamphetamine from his pocket. He allowed the officers into the house to look for items, and the officers later obtained a search warrant for the residence, the document says, and found numerous items identified as drug paraphernalia as well as a small amount of methamphetamine and three prescription painkiller hydrocodone pills in a prescription bottle for an anti-anxiety medicine.

Another Judge slaps a wrist and turns another drug dealer free. It is no wonder why Hill County and Havre is so full of drugs when nothing happens to the drug dealers but a slap on the hand. Wake up people,is this what you really want for Havre ?
