Rocky Boy election hearing is Dec. 16

The Chippewa Cree Tribal Courts set Dec. 16 as the date for the hearing of Jonathan Windy Boy’s injunction.

Windy Boy filed the injunction with the court after the election board for Rocky Boy's Indian Reservation Business Committee rejected his objection to the results of the election Nov. 12.

“Jonathon is requesting the Chippewa Cree Tribal Courts grant him an injunction until all legal remedies have been exhausted,” read court documents granting Windy Boy the hearing. “ … There are some questions that can only be answered with further Court Proceedings.”

Calls to the tribal offices and various members of the Business Committee, current and newly elected, were unanswered or were refused.

Windy Boy filed the objection to the result because Father Pete Guthneck, an honorary member of the Chippewa Cree tribe, voted in the election. Windy Boy said this is a violation of the tribal constitution.

Until the four newly elected members of the business committee are sworn in, the original eight-person Business Committee will continue to serve, said Lynn Fagan, the attorney for the election board.

“The court will make a decision, hopefully,” Fagan said. “And hopefully we’ll be able to swear in the new people.”

There are eight members on the committee, but one seat is vacant because Chance Houle was suspended after his indictment on corruption charges.

Rick Morsette is acting chair. Ken St. Mark was elected to the post, but those results are also being challenged.

What a joke to the RB people. This election broad, this court, and Jonathan will mount to nothing, but present indicted councilmen still making the decisions here on the Rez. They need to solve this and carry on with important Tribal Operations the Tribe faces everyday... But com'on! ONE vote, and he had a tribal ID. WE need to swear these news ones in and revise this whole rip-off minded REZ!
