Box Elder man ruled unfit to stand trial

A Box Elder man who was charged with attempted murder has been deemed unfit to stand trial.

Shane Hiawatha Denny was committed to the attorney general for 45 days to “receive psychiatric or psychological examination as to whether his mental disease or defect will create a substantial risk of bodily injury to another person or serious damage to property of another.”

Denney had been charged with assault with intent to commit murder, assault with a dangerous weapon and assault resulting in serious bodily injury was deemed unfit to stand trial.

He is being accused of intentionally assaulted someone with intent to commit murder by stabbing them in the back with a knife Sept. 17, 2013, on Rocky Boy’s Indian Reservation.

An indictment against Denny was file Oct. 3, 2013, and he shortly thereafter pleaded insanity and was given a psychological evaluation.

Feb. 13, 2014, he was found to be unfit for trial and has been evaluated intermittently since.

The director in charge of his current evaluation may apply for more time, but that extra time may not exceed 30 days.
