Man charged with sexually assaulting 13-year-old

A foreign national who was doing construction work in Havre faces charges he sexually assaulted a 13-year-old Havre girl who met him via Facebook.

Eblin Javier Caceres-Martinez, aka Javier Martinez, of Honduras is in the Hill County jail on $50,000 bond facing charges of sexual assault, a felony, and unlawful restraint, a misdemeanor.

An arraignment hearing in which Martinez would enter his initial plea was scheduled for this morning but was expected to be continued until an interpreter could be found.

According to a charging document, a Havre woman brought her daughter to the Havre Police Department Oct. 14 and reported a sexual assault.

The girl told officers that she had met Martinez on Facebook and invited him to come to the Havre skate park to hang out with her and her friends.

When officers investigated Facebook and cellphone messages, they found that the 13-year-old told Martinez she was 14, and he told her he was 17, the document says. Martinez was 19 at the time.

The girl told officers that Martinez wanted her to get in his pickup truck so they could go somewhere and be alone, but she did not wish to leave her friends.

She said Martinez reached past her while she was talking to him in his truck and closed the door and drove south of town.

She said he pulled over to the side of the road, turned off the truck’s lights and began kissing her and groping her.

The girl said she told him to take her back, and Martinez would drive a short distance, stop and continue touching her, the document says.. He stopped once she said she would call the police, the girl said, and he dropped her off near the skate park.

Friends of the girl interviewed by police officers said she seemed nervous when Martinez dropped her off and that he slammed shut the passenger door when she got out and sped off.

When officers interviewed Martinez, he said he went to the skate park to meet a girl he met on Facebook and admitted kissing her after she asked him to drive her around.

He initially told the officer the girl was 16, but said she was 14 after the officer told him about the Facebook and cellphone messages the document says.
