A Havre man was sentenced Monday in District Court in Havre to probation for pointing a pistol at a man and for having drugs without a prescription.

Eric William Brewer, born in 1993, received a three-year deferred imposition of sentence for felony assault with a weapon and a two-year deferred imposition of sentence for felony criminal possession of dangerous drugs. The sentence was part of a plea deal that dismissed a misdemeanor charge of carrying a concealed weapon offense, and if Brewer abides by the conditions of his release he can have the offenses struck from his record after the three years.

Officers arrested Brewer after an investigation that started when a man called 911 Oct. 19, 2016, to report a man pointed a gun at him at an 11th Street West gas station.

An officer responded and found Brewer inside the gas station. Officers frisked Brewer and found a Ruger P94 pistol. Brewer, who did not have a conceal carry license, told officers he bought the pistol through a private sale.

The man who called the police said he was near a friend’s vehicle in a restaurant parking lot when Brewer pulled up in a blue Mercury. He then heard a “dry fire” and when he looked, Brewer was pointing a gun at him. The man said he is familiar with firearms and was sure what he had heard was a dry fire.

The man said Brewer then drove away.

The man said his friends followed Brewer to get the license plate number but did not approach him to prevent further confrontation.

On the drug offense, officers questioned Brewer Dec. 9, 2016, at the Havre Police Department about an incident. While at the police department, the investigating officer noticed a bag was sticking out of the pocket of his shirt. Officers found Brewer was carrying several Xanax pills he did not have a prescription for.
