Man gets 5 years for raping sleeping woman

A Plentywood man who raped a woman while she was asleep when he was visiting her in Havre in 2013 received five years with the Department of Corrections Monday afternoon in District Court.

Kevin J. Kavon, born in 1979, received 10 years with five suspended with the Department of Corrections for the offense of sexual intercourse without consent.

Kavon was charged after emergency room personnel from Northern Montana Hospital contacted law enforcement Nov. 16, 2013, to report a possible rape.

The woman who said she had been raped told officers Kavon had come from Plentywood to visit her in Havre. She said that while they were watching movies, he offered her methamphetamine, which she declined. He smoked some meth, the woman said.

She said she fell asleep, and when she awoke Kavon was having sex with her. She said he was pinning her down and choking her throat while it occurred, and that it lasted about a half an hour.

He then left, she said, and when the person who has medical power of attorney for her called later, she said she had been raped and was taken to the hospital.

Kavon told Sheridan County law enforcement officials that he had not smoked meth, and that he and the alleged victim had consensual sex, although he denied her claim that he had anal sex with her.

Kavon refused to take a drug test at the time.

The Montana State Crime Lab later performed tests which confirmed Kavon’s DNA was on samples from the victim, including a rectal swab, the document says.
