District courts last cases of 2000

Five people pleaded guilty to crimes, admitted violating conditions of their release or were sentenced in 12th Judicial District Court recently.

Debra Lynn Nesbitt, 44, Havre, pleaded guilty to intimidation Dec. 6 and was sentenced to one year in the Hill County Detention Center. Nesbitt was charged with trying to arrest a person for recovery of a $5,000 bail bond. The sentence was suspended on condition that Nesbitt pay $5,330 restitution, remain law-abiding, refrain from possessing or using firearms, report her address to the Hill County Attorney and pay her surcharges.

Michael James Franks, 24, Havre, was sentenced Dec. 7 to seven years in Montana State Prison in Deer Lodge, all suspended. Franks had pleaded guilty earlier to having sexual contact with a 13-year-old girl in January. He was further ordered to serve 90 days in Hill County Detention Center, abide by conditions set down in his presentence investigation and complete a sexual offender program.

Casey Owen Mummey, 20, Havre, admitted Dec. 11 to violating conditions of his release by committing partner assault and a minor-in-possession of alcohol offense. Mummey's one-year suspended sentence was revoked Dec. 22 and he was sentenced to six months in jail with all but 60 days suspended. He was given credit for 52 days already served. Mummey was ordered to abide by conditions of release, including living with a family in Flandreau, S.D., completing outpatient treatment while in Flandreau, refraining from using street drugs or alcohol and staying out of Montana. Mummey had pleaded guilty to theft and assault charges on Sept. 28. The charges involved a robbery at a home in the 400 block of 10th Avenue.

Jason Richard Delorme, 20, Havre, pleaded guilty in December to burglarizing a Havre apartment in October 1999. Taken from the home were a stereo, two phones, CDs, microwave oven, human skull, camera and scanner for a computer. Delorme was ordered to undergo a presentence investigation. Sentencing was scheduled for 2:30 p.m. Feb. 9, 2001. The maximum penalty for the offense is up 20 years in prison and a fine of no more than $50,000, plus a $20 prosecution fee, $10 victims' fee and $5 surcharge.

Troy McGarvey, no age given, Kalispell, pleaded guilty Dec. 22 to theft for taking several items from a garage on Washington Avenue on Feb. 19, 1977. A presentencing investigation was ordered. Sentencing was set for 1:30 p.m. Feb. 9, 2001. The maximum penalty for the offense is up 10 years in prison and a fine of no more than $50,000, plus a $20 prosecution fee, $10 victims' fee and $5 surcharge.
