Casino robber back in jail for drinking

Merrill Gray is being held in the Hill County Detention Center this morning, just two days after his sentencing for robbing a casino at knife-point was delayed.

Gray was arrested for violating his conditions of release at 3:14 a. m. today at a party in Havre.

Less than 48 hours ago, Hill County Attorney Gina Dahl was arguing to Judge E. Wayne Phillips of Lewistown that Gray's repeated violations of his conditions of release, mainly by drinking alcohol which he is not allowed to do, made him unsuited for a deferred sentence.

Gray's probation officer Katie Kuhr said that Gray told her that he still drinks at least once a week, though he has only been arrested for doing so twice, now three times, since he was arrested in late 2010.

After Kuhr said she was unsure of her initial recommendation, that Gray's sentence be deferred, Phillips gave her an additional week to write another recommendation, and gave the defense another week to prepare to argue on that recommendation.

The new sentencing will take place on Monday, May 21, at 11 a. m.
