Rape defendant fails to show for arraignemnt

A man accused of raping a 15-year-old girl failed to show up for his arraignment hearing that was scheduled for Monday in state District Court in Havre.

Nicholas T. Henderson, whose age and place of residency were not available, was charged with one count of sexual intercourse without consent Feb. 9.

A $50,000 warrant has been issued.

According to court documents, in February 2013, Henderson and another man picked up a 15-year-old girl and another juvenile and brought them to a party, where alcohol was served.

Due to extreme intoxication, the 15-year-old girl could not remember exactly what happened, but vaguely remembered being on a mattress that Henderson had been trying to get her onto.

The court documents go on to say that another man told officers he had walked in on the girl and Henderson having sexual intercourse.

The 15-year-old girl subsequently discovered she was pregnant. After the child was born, DNA and paternity tests showed a greater than 99 percent match to Henderson and he was determined to be the father of the child.

Officers have learned Henderson has moved to Arizona and may be working at a Chili’s restaurant there, the court documents say.
