From the Courts - State District Court: HasEagle resentenced to probation for violation

A man was resentenced to his previous suspended sentence with recommendations he be screened by the state parole board and placed in treatment.

Donald J. HasEagle appeared in state District Couri in Havre Wednesday for disposition of a petition to revoke his suspended sentence in a 2013 aggravated assault charge stemming from allegations of a sex offense.

HasEagle was sentenced by state District Judge Dan Boucher Nov. 24, 2014, to 17 years with 12 suspended and named a persistent felony offender.

He had pleaded guilty in a plea agreement to the aggravated assault charge, which was amended from a sexual intercourse without consent charge.

In March, Hill County Attorney’s Office filed a petition to revoke his sentence due to allegations of partner or family member assault and testing positive to use of methamphetamine and amphetamines.

HasEagle had been released into community supervision by the state Department of Correction.

Wednesday, Judge Kaydee Snipes Ruiz, who took over jurisdiction on the case after she was appointed to take the place of retiring Judge Boucher, resentenced HasEagle, saying in her order that the court was concerned about his substance use and chemical dependency, but as he has not yet started his suspended sentence, that struggle could best be addressed through the DOC Parole Board.
