From the Courts - State District Court: Man sentenced in embezzlement case

A man who had a charge of embezzlement brought back after he failed to pay restitution has been sentenced to probation and again ordered to pay the restitution.

Jordan Gardipee was charged March 29, 2019, with theft by embezzlement by common scheme, a felony, after a Havre business reported he had been pocketing money from his till and under ringing customers and taking the difference.

A court document said Gardipee had underung 145 items in transactions with 28 customers including friends and relatives between Feb. 26, 2019, and March 21, 2019.

The prosecution previously had deferred prosecuting the case under an agreement with Gardipee, but moved to reinstate the charges Feb. 24 when he had failed to pay the restitution.

June 23, Gardipee pleaded guilty to the charge.

Monday, state District Judge Kaydee Snipes Ruiz imposed a two-year deferred imposition of sentence and ordered Gardipee to pay $1,532.69 plus fees in restitution and to pay $130 in court fees and surcharges.

If Gardipee abides by all conditions of release, after the deferred imposition is complete he can petition to have the charge struck from his record.
